Terms of Service

These terms apply to the use of tillthen.space, a service operated by Switch, Hauptstrasse 68, 39018 Terlan (BZ), Italy, and are governed by Italian law, in particular the Italian Consumer Code (Legislative Decree No. 206/2005, "Codice del Consumo") and the Italian Civil Code (Codice Civile).

1. Scope

These terms apply to all users of tillthen.space, whether acting as a consumer within the meaning of Art. 3 of the Codice del Consumo or as a business.

2. Service description

tillthen.space lets you leave an encrypted message ("vault") that gets delivered by email to a recipient at a time you choose.

3. Pricing

Free: up to 10 vaults per month, as long as delivery is within 2 weeks of creation.

Paid: any vault scheduled more than 2 weeks out costs $1/month, billed monthly on a recurring basis via Stripe, until the vault is delivered, deleted, or rescheduled to within 2 weeks. All prices are exclusive of applicable VAT unless stated otherwise.

4. Payment

Payments are processed by our payment provider, Stripe. Creating a paid vault authorizes recurring monthly charges until the vault is delivered, deleted, or rescheduled to within 2 weeks.

5. Cancellation / termination

You can stop billing for a vault at any time by deleting it or rescheduling it to within 2 weeks. Account management happens through the dashboard.

6. Right of withdrawal

Consumers resident in the EU generally have a 14-day right of withdrawal under Art. 52 et seq. of the Codice del Consumo. [Placeholder -- needs legal review: since billing for a paid vault starts immediately on payment, explicit consent must be obtained before payment, per Art. 59(1)(a) and (o) of the Codice del Consumo, that performance begins immediately and the right of withdrawal is thereby wholly or partly lost. This consent step is not yet implemented in the current checkout flow.]

7. Liability

We are not liable for delivery delays or failures caused by circumstances outside our control that are not attributable to us under Art. 1218 of the Codice Civile, such as issues at email providers. [Further liability limitations should be reviewed by a lawyer.]

8. Governing law and jurisdiction

These terms are governed by Italian law. For disputes with consumers, the competent court is mandatorily that of the consumer's place of residence or domicile, under Art. 33(2)(u) of the Codice del Consumo.

9. Changes

We reserve the right to change these terms with effect for the future.
